Bhavan had filed a suit in the High Court
of Mumbai against the so called “Vidyabhavan Public School
Society” ,patronized by Shri Dhirubhai Mehta, former Executive
Secretary of Bhavan for infringement of Bhavan’s trademarks,
by deceptively using its name and logo, and had taken a Notice
of Motion for interim injunction against their using their
deceptive name, logo etc.
Our Notice of Motion came up before the Court of Hon’ble
Justice shri V.M. Kannadi, on 6th August, 2008.
Bhavan had prayed that the so called Vidyabhavan Public
Society be injuncted from using this name, or its logo or in
any manner infringe Bhavan’s copyright in its logo. Our senior
Counsel, Dr.V.V. Tulzapurkar, who is an authority on copy
right laws, brilliantly argued our case.
After hearing both sides Justice Shri Kannade accepted our
stand and pending the final disposal of the suit granted
immediate relief on all the counts prayed for.
Justice Shri Kannade also refused the prayer of the Society
for a Stay Order for two weeks to enable them to appeal and
allowed the dependents three weeks to comply with the Court’s
Order.
It was noted that the Society’s website carried material
blatantly copied from Bhavan’s own website including
photographs of Bhavan’s Central Office Building, Munshiji’s
photograph and a lot more. They had agreed before the Judge
last month that they would remove them forthwith. They merely
changed their website and continued to use our material. This
was detected by us and evidence submitted to the Court when
they represented that they had complied with the Courts
earlier order. |
